(Western New York, January 20, 2007) - - The case against alleged bike path rapist Altemio Sanchez will soon be heading to a courtroom. Friday, a Grand Jury decided there is enough evidence to indict sanchez in the 1990 murder of UB student Linda Yalem, and the 1992 killing of Mayjane Mazur.
Sanchez's defense attorney says he will challenge how the prosecution collected its DNA evidence. He is also objecting to comments made regarding a picture of Sanchez, taken on the same day Joan Diver was murdered.
Andrew Lotempio, Sanchez Defense Attorney: "There's a picture of a guy at a party on a certain date. If he didn't do it it's a guy at a party having a good time with his wife. If he did it, then there are arguments in the other way. It's really not a piece of evidence that proves anything."
Frank Clark, Erie County District Attorney: "If you assume that he did what we allege he did and can be enjoying himself in social circumstances six or eight hours later, that to me is chilling."
District Attorney Frank Clark believes it may be another six to eight months before a trial could begin.
